Provided a critical evaluation of a site damaged by an oil spill from an underground tank.
Case # 4: U.S. Government vs. a Manufacturer of Oil / Water Separators
Expert witness for the Defendant.
Provided a critical review of testimonials in relation to an attempt by the defendant to change "Termination of contract for cause" to "Termination of contract for convenience". Contractor failed because of U.S. Govt. claim that performance test results exceeded a target limitation by 20%. Review of the test procedures and data showed that there was a
sufficient ambiguity in the specifications that could mean that the data obtained in the performance tests could actually be considered acceptable.
